UK Government forced into climbdown on inheritance tax for farmers

The UK government has executed a substantial U-turn on its controversial inheritance tax proposals for agricultural businesses, raising the threshold for full relief from £1 million to £2.5 million following months of sustained pressure from the farming community and dissent among Labour's own backbenchers.

The revised policy, announced by the Department for Environment, Food and Rural Affairs on 23rd December 2025, represents a significant retreat from the original proposals unveiled in Chancellor Rachel Reeves's Autumn Budget. Under the modified framework, spouses or civil partners can now pass on up to £5 million in qualifying agricultural or business assets before incurring inheritance tax liability, when combined with existing nil-rate bands.

In her inaugural Budget last October, Chancellor Reeves announced plans to impose a 20 per cent inheritance tax—half the standard rate—on agricultural assets exceeding £1 million from April 2026. The policy, which reversed a complete exemption introduced by John Major's Conservative government in 1992, was projected to raise approximately £520 million annually by 2029-30.

The proposals triggered immediate and fierce resistance from the agricultural sector. The National Farmers' Union coordinated sustained protests in Westminster, with thousands of farmers descending on Parliament Square in November 2024, brandishing placards declaring "No farmers, no food". The demonstrations, dubbed the "Great British Tractor Rebellion" by media outlets, represented one of the largest protests against Labour policy since the party assumed office in July.

Tom Bradshaw, NFU president, described the original changes as "pernicious and cruel", arguing they trapped "the most elderly and vulnerable people and their families in the eye of the storm". The sector's opposition centred on the reality that many farms, whilst asset-rich, operate on minimal profit margins, raising concerns that heirs would be forced to sell land to meet tax obligations.

The government's position became increasingly untenable as dissent emerged from within Labour's own ranks. More than 20 Labour MPs, predominantly representing rural constituencies, abstained from a parliamentary vote on Budget Resolution 50 in early December. Penrith and Solway MP Markus Campbell-Savours went further, voting against the proposals and subsequently losing the Labour whip, becoming an independent MP.

Campbell-Savours told the Commons he had reassured farmers during the election campaign that Agricultural Property Relief would not be altered, based on commitments from the shadow environment secretary. "I was one of those Labour candidates, and it's for that reason I'll be voting against the Budget resolution enabling these changes," he stated.

The abstentions, whilst not binding, demonstrated significant backbench opposition and placed considerable pressure on the government to reconsider. Labour MPs including Samantha Niblett (South Derbyshire) warned that "we have lost the trust of our farmers", whilst others highlighted the distress caused by anti-forestalling clauses affecting elderly farmers unable to utilise gifting provisions.

Prime Minister Sir Keir Starmer met with NFU president Bradshaw twice in the weeks preceding the U-turn, with the farming leader describing the discussions as "very constructive". The government's eventual capitulation also followed publication of the Batters Review, an independent assessment led by former NFU president Baroness Minette Batters, which found nearly one-third of farms in Great Britain were loss-making in 2024.

The modified policy substantially reduces the number of agricultural estates affected by the reforms. According to government figures, estates claiming Agricultural Property Relief (including those also claiming Business Property Relief) impacted by the changes will halve from 375 to 185 in 2026-27. Overall, approximately 1,100 estates across the UK will now pay additional inheritance tax, down from the 2,000 originally forecast.

Environment Secretary Emma Reynolds stated: "Farmers are at the heart of our food security and environmental stewardship, and I am determined to work with them to secure a profitable future for British farming. We have listened closely to farmers across the country and we are making changes today to protect more ordinary family farms".

Under the revised arrangements, around 85 per cent of estates claiming agricultural property relief are forecast to pay no additional inheritance tax. For couples, the combined threshold of £5 million, comprising two £2.5 million agricultural property allowances and two £325,000 nil-rate bands, could reach £5.65 million when all available reliefs are utilised.

The U-turn will cost the Treasury approximately £130 million annually, reducing anticipated revenues from the policy to around £300 million per year. The changes will be introduced via amendment to the Finance Bill in January 2025 and will apply from 6 April 2026.

The NFU welcomed the announcement as bringing "huge relief to many" farming families, with Bradshaw stating: "While there is still tax to pay, this will greatly reduce that tax burden for many family farms, those working people of the countryside". He acknowledged the role of Labour backbenchers in securing the changes, particularly those who abstained despite political pressure.

However, campaign group No Farmers, No Food cautioned that whilst the threshold increase represented "a huge victory", it remained insufficient and urged complete abolition of the policy.

Opposition parties criticised the government's handling of the issue. Conservative leader Kemi Badenoch described the inheritance tax as "cruel and immoral", adding: "This fight isn't finished. Other family businesses are still affected by Labour's tax raid, and we will keep pushing until the tax is lifted from them too". Liberal Democrat environment spokesperson Tim Farron condemned it as "utterly inexcusable" that farmers had endured "over a year of uncertainty and anguish".

Whilst the revised threshold provides relief for many agricultural businesses, tax advisers have noted that some families have already made "irreversible decisions - selling land, restructuring businesses or accelerating succession plans - because they believed the rules were settled". Phil Kinzett-Evans, partner at UHY Hacker Young, observed that the policy uncertainty had prompted premature restructuring that cannot now be undone.

The changes also maintain the broader principle that the largest estates should contribute to inheritance tax revenues. The government emphasised that only the most valuable agricultural and business assets will face taxation, with the effective rate of 20 per cent remaining substantially below the standard 40 per cent inheritance tax rate.

The climbdown represents the latest in a series of policy reversals by the Labour government, following similar U-turns on winter fuel allowances for pensioners and disability welfare reforms. The episode underscores the political sensitivity of policies affecting rural communities and the influence organised sectoral lobbying can exert on fiscal policy, even when governments command substantial parliamentary majorities.
